SHOT ON RED Film Festival Submissions Open

Hi Brian,
I tried to email you but I guess that your inbox is pretty full in these deadline days :)
Anyway, I just uploaded a screener of Lenny Lump using an FTP client instead and I was wondering if it was watchable this time? :)

I/We grant RED, RED Studios Hollywood, and their distribution partners and sponsors the full and royalty-free right and permission to use my FILM for broadcast, duplication, and advertising in association with RED, for the purpose of viewing on television, in theatres, on the internet, on the RED website, on distributors’ or sponsors’ websites, podcasting and/or for archival purposes and for any other valid, lawful purpose in any and all media now known or hereafter developed or devised, worldwide and in perpetuity. I/We waive any right to inspect or approve the finished videotape, sound track, photograph, advertising copy, audio piece or printed matter that may be used or to the eventual use that it may be applied.

Is this normal language for festivals? I am no lawyer, but this appears to be assigning all rights to RED in perpetuity.

I stumbled over this too. And about the fact that sometimes it was said 15 minutes versus 20 minutes for short movies, ProRes and DCP versus ProRes, DCP and DNX (meant was probably DNxHD?). These papers looked a bit like being made/copied together in a rush.

Honestly I believe its was not intended how it was written. However, its a contract and legally binding!
My hope/understanding is that they meant the 3 minutes extracts for advertising which they can/want to use in perpetuity afterwards.
But as there is written "the FILM" its not saying that, but instead the entire movie!

And then there is to read "royalty-free right and permission to use my FILM" - which would mean you do not even earn money with it when they use it (the entire movie).

So everyone who send in a movie and filled the papers has now legally given it away as a free gift to RED and the upcoming 4K distribution channel, from now to forever?

Some insights would be - with all due respect - helpful.

Well, I disagree.

Do you upload distribution quality master files of your complete movies to those platforms?
Maybe a trailer...

But for the ShotOnRED Festival its requested to send your entire movie.

I've send material to several festivals in the past, but something like "we get your material for free, forever" was never in there. And I don't believe that RED aims that way. However, taking that text part word for word would imply that they get usage and distribution rights for free, forever. But I am not a lawyer as well. Its irritating!

Again, someone from RED should explain, because THEN its an official statement. We can only speculate.

I trust that RED is working in the content providers' best interests... i.e., I/We grant RED permission to give a copy of the FILM to industry members, including but not limited to network executives, agents, managers, casting directors, press, producers, distributors, and others that might aid in securing future work and/or distribution of the FILM.

I see RED as being pro-active in putting 4k content providers in touch with those seeking 4k content. There's no way RED is trying to usurp the provider's rights, but they must protect themselves to the extent they are not restrained in the ways they can facilitate such a win, win, win proposition.

This is a "Big Picture" company. I think we can trust them to see all viewpoints, including the Festival particpants' side.

I don't think anyone is trying to accuse RED of something sinister. If the contract language really means signing over all rights, then that is just something to be aware of. Nothing more. No one is forcing anyone to submit anything. This promises to be a great event and I am looking forward to seeing what is submitted. I hope the finalists will be made available for viewing to the community (I probably won't be able to get to RSH, unfortunately).

Nothing sinister.. but if you don't like the terms.. you don't need to enter.

is anyone having any luck uploading today? I keep getting timed-out, with no progress.

FTP server is working, just double checked it - John, we have both of your submissions.

Notifications will be pushed to next week - submissions are still being uploaded, dropped off at the RED Studios and emailed. We will let you know as soon as we can what submissions will be screened during the festival.

Brian,

Thanks for everything.

Best,

Will Keir

Thank you Brian, Jarred and Red for doing this! Looking forward to hearing if I got in.
