cant you just forward the site to another URL for starters without the word red in it? or perhaps explain to them that your using red as a china reference and not a red digital cinema reference? shutting down the site is another quick fix, but if that would damage your brand leave it up and change the URL and whatever titles say Red in it and just set it up to forward for now from your old URL...hopefully that would be enough?

You know that Oakley then RED is beyond hypersensitive about trademark infringement. RED somehow convinced the trademark office in the USA to give them very wide latitude with the word "Red" in association with all things film. You have "Red Film" as your name and on your current front web page advertize "RED cameras" thereby making the trademark link. This is a great way to start a fight that you would quickly lose in court. Add to that you state above you are shooting your HBO project on Alexa's. Why that detail if not to be combative?

That all said - trademark infringement or other related legal disagreements should not be linked to service claims by any manufacturer. But RED is the single source for service and sales so they have the power to do that. All of this is a known so those who choose RED should know what they are getting into when buying a RED camera system. No surprises here.

Sounds pretty bizarre in my book.

Not sure if this is a good idea on the long run.
I already had a few producers ruling out the use of Red cameras,
because they think, that they could run into serious problems when sh..t happens.

Coupling so called "infringement" (and it is not even proven, that this is the case here)
with a warranty my be illegal in the first place, but I'm no lawyer.
I'm pretty sure it would be major illegal here in Germany though.

Why on earth would you name your company "redfilmsasia" if it was not to gain from the RED trademark? I'm guessing that your company did not open up shop before RED...

To me it's quite an obvious case. If people could start up companies under names like "RED Rental", "RED films" etc then that would not help the company name at all. It's quite standard, you cant really go and start "Arri films Europe" or "Panavision Films" or "machintosh computers" without consent with those companies. Same with RED, even tough RED is the name of a color it's very much a registered trademark.

So the only way to win that battle would be if you started your company before RED if not then I think the smart move would be to step back. When you bought the camera you agreed to the terms and conditions... they are quite thick, among other things they reserve the right to not service people with attitude. Not saying that you have one but looking from where RED is standing I can totally see why they do what they do in this case. And yes, further more so if the films are not shot on their cameras.

As Bjorn points out, Red Film Asia seems to have pretty close association with Red cameras and RDC. Unless, of course, they can prove they were using this name before RDC came in to existence. :huh:

Back in 2007 I grabbed a few 4k domain-names. And let them go, without red interference. I used one for a bit of articles and analysis of the R1M. But just let it slip when it was time to renew.

Looking back, I can understand why that was a natural thing to aquire... and let go...

Not quite sure why you would take that view; 'RED' is sure a trademark. '4K' is a measurement, a dimension, a standard, a very common expression today. Don't see the relationship.
