RED is a trademark...

Would a disclaimer solve these issues?

A disclaimer is good practice, but isn't a cure all.

Put simply RED spends a lot of money to build a brand. A brand that associates the word RED within the field of digital imaging and production with their products and development efforts. They can't have other people using the brand they have created, or worse still confusing consumers with brands that are similar but not from RED.

If I call myself REDStore and then release a product that is a complete turd and ruins people's shoots then that would have a negative impact on the RED brand, even though it had nothing to do with them.

Not saying everyone using RED in the name will cause chaos and stiff customers, but RED can't take that risk with their brand.

Make a brand around something else, if you want to use a RED-something domain name as a forwarder then you're not terribly out-of-line but you should talk to RED about it. And make sure it's not your primary domain - if I registered redstore.com and had it pointed at my site, I'd make sure that when you typed it in you ended up at shotwrangler.com/solidstore

Would these get someone in trouble?

Nah, mate. These are clearly 8-bits per pixel. No confusion over 10+ bit dynamic range of RED. Sony can use them as much as they like...

Hey Jarred, what about DVX USER? I suppose some people wouldn't be where they are today if it wasn't for trademark infringement, eh? Canadians rule.

Well joking aside I say you sue everyone's ass who uses RED in their company name and or URL's

This posting will probably be erased.

That's the best answer yet, Jarred! :-)

Then your a good boy. I personally think you helped Panasonic sell a few hundred thousand more than they would have.

There is some law against trademarking commonly used words and phrases and expressions.

My children say there are 6 colors in rainbow and one trademark.

I usually eat RED* tomatos and when I pee urine come out RED*.

I hope Jim will trademark F word and N word next. That way if someone use those words in public, that person can be sued into silence.

Just RED* neck humor.

*RED is Trademark of Jim. Other English words in this post are Trademarks of others.

Lewis and others above referred to web addresses with "red" in them in the context that Jarred et al are coming down on this use. Jarred, please confirm. Protecting the business name and product "Red" is fine. I question if "red" in a domain name is a conflict if, once you open the site, it is clear that another entity or service is involved and not the Red company. But is Red objecting to such phrases as Red for Rent? Red repaired here? i would like to see examples of web addresses that Red is objecting to.

That RED is always written in capital letters here means probably that they didn't trademark the color red (which isn't possible, at least not in this country and brandlaw seems very international these days) but their Lockheed-Martin-Logo.

My question is, why is this being brought up so late in the game?

It didn't need to be brought up at all. I think it was brought up out of courtesy and/or because of an increased need. By now RED is well recognised brand name within the industry, so it is also a good time to remind uneducated masses about things such as trademarks...

Many companies do not give this courtesy at all. They just sue. RED is different. They inform, then ask kindly and, if all of this doesn't work, oh well...:matrix:

i just trademarkeded the letter E and O, so please no one use this, or i'll get the red bloodhounds to hunt you down.

My company is called "RED Herring camera crew", founded 1993...
Should I sue RED? :sarcasm: :)

This is all getting silly now and semantic. Just don't use the name RED to capitalize on their trademark. Its a simple request. Either adhere to it or go to court.

If you feel you can't make money as a DP, rental house, or other business without using the name RED, then you are a completely uncreative individual in a creative field. Use some of that talent and come up with a new name that doesn't associate it self with others success.

Jim and Jarred are right and they are asking nicely.

Hi,

As RED is not in the business of supplying camera crew there is no confusion. Film companies have existed for many years with Red as part of their names, many are not customers of RED either.

So whats the deal with the new LG Scarlet screens?? Who was first t get that the bite on that apple? Will we see a corporate battle over that?

I guess there will be a run on the word 'Claret' in the coming weeks.

Best of luck to everyone entering that fray!
Mark.
