This is kind of a terrible subject to introduce myself to this forum, but here it goes... :-s

We are in the process of adquiring a DI/RED solution and we are interested in 3 diferent platforms, one of them is SCRATCH.

Just wanted to find out what do you guys know about a rumor that autodesk has taken assimilate to court over its similarities to cyborg (which autodeks owns now)

I hope this isn't real, since SCRATCH was a very tempting option, but I am not willing to spend 80K+ on a system that has litigations attached to it and god knows what kind of support we could get if autodesk has its way.

please, what would you do?

thanx

You are right, this is a terrible subject to introduce yourself with. And to make matters worse, you have no name, no location, no website...

I'm sure you would be just as suspicious as us if the shoes were on the other foot.

Have a good one

Jay

Potentially inflammatory post by a one time poster, who happens to be named, "poster"?

Smells of fishy BS to me. Unless "poster" wants to step up and identify themselves, they have a largely negative credit rating at this point.

Jeff,

Why not delete this thread, and if a "real person" wants to post this, then fine.. But let's not start such a serious thread off with a post from an "unknown"

Just a suggestion

Hey! I was looking for some info.

Its understandable that if I am considering a purchase i would like to know as much as possible.

I am a new poster because till i wanted to have RED/DI workflow i had little need to post here, i did read a lot.

BTW, here is a link i found of the lawsuit in delaware court.

http://dockets.justia.com/docket/court-dedce/case_no-1:2008cv00587/case_id-41031/

Please understand that my intentions are to inform myself as much as possible before spending this amount of money and in no way was I intending to
"Swiftboat" the scratch.

Moderators, if this is a taboo subject, or the wrong place to post, please delete this thread.

I am not looking to make enemies and I apreciate reading this forum at times.

thanx

This is the only thing I could find about a lawsuit.

Who knows what the details are. I think the point is that companies deal with all kinds of legal matters, it's part of business.

I'm sure Lucas can clarify this if he wants too, but I wouldn't hold back your decision to purchase Scratch based on this.

I think everyone should be very careful with regards to what they say about ongoing legal proceedings.

It's not a taboo subject, but it is suspicious that it would be your only post and even when Jay challenged you to identify yourself and therefore your potential bias or possible gain from causing uncertainty about another company, you ignored it. Now's your chance.

I agree with the two other posters. Legal challenges, some meritorious but often frivolous are a constant problem for small businesses.

and one should be very careful posting about ongoing litigation, particularly when it is a deep pockets company going after a small company.

I think this is an issue which should be fully addressed here on RedUser, not just for idle curiosity or for those with Scratch, but because most of us use RedCine, which could be affected by litigation against Assimilate.

Best regards to all,

Leo

...just when I thought I had decided!

Hi, "poster",

This is not a taboo subject. It's just that we deal with many posts intended to instigate and provoke the community, every day. And typically they are from anonymous new users, one-time posters such as yourself.

But as Steve pointed out above, this is just part of doing business. At this time, it seems there are no details to be had or real indication of what this is all about. It may be entirely trivial or about some little feature or color shceme or who knows what or entirely frivolous. Assimilate has been very much supportive of their customers and the RED community. I trust that any details that will affect their customers and potential customers will be revealed in due course.

I think everyone should be very careful with regards to what they say about ongoing legal proceedings.

Yep.

From my understanding Cyborg got absorbed by the Systems products from discreet.

I believe COLOSSUS which was an offshoot fo colorfront by some turkish dudes (i think) was converted to Lustre.

Of course, I could be wrong.

Autodesk is claiming copyright infringement of key user-interface elements which were unique features of Cyborg, and were incorporated into the Autodesk suite when Autodesk purchased Cyborg from 5D in 2004. Autodesk is claiming that many of those same key features are also used by Assimilate, which was founded and owned by previous employees of 5D.

From reading the docket, many of the interface features claimed under infringement are also found in RedCine, including gestural swipes, Ok/Esc buttons within buttons, the appearance of buttons, the popup calculator, etc.

Autodesk also suggests that based on these similarities in the user interface, that it is possible "that portions of the underlying Cyborg source code and/or the structure, sequence, and organization of that code were copied as well."

Perhaps the most significant of Autodesks claims, is this: "Autodesk is informed and believes that Mr. Huisma, who appears to be the principal programmer at Scratch, improperly retained a copy of the Cyborg source code after his employment with 5D terminated as a result of its liquidation."

If anyone would like a copy of the Main Document submitted with the complaint, let me know and I can post it.

Please do. I'm getting kinda curious.
Avid DS has the pop-up calc too so that's hardly unique.
I'd hate to see Assimilate in trouble. fingers crossed.
