  • Hey all, just changed over the backend after 15 years I figured time to give it a bit of an update, its probably gonna be a bit weird for most of you and i am sure there is a few bugs to work out but it should kinda work the same as before... hopefully :)

Trying to evade rental amount and lost 4 cards - Advice please!!!

invoice factoring works on confirmed good quality invoices to collect on. I know since a good friend runs one of the largest in the country. They do NOT want bad debt...only good invoices that pay 30-90 days out with confirmed good standing usually over years.

What you want is a debt collection agency...but doubt you have anything to offer them since you don't have a contract. Don't even waste your time with this route.

File a police report; then small claims. Waiting is weak, put some fire under this guy's ass. Tell him you are filing tomorrow in small claims and filing a police report for stolen cards and he was last in possesion. Tell him he has 12 hours to respond in writing he will pay you=--he won't do that. might ask for weeks to pay you. DON"T give in....file. you'll see how putting this in motion will get results if he's anybody in the business or wants to work in the business.

This is what I'd send...

Dear X,

Its been over a month now since you rented my gear and I have not received payment yet. Since you are the last person to have custody of my CF cards, I have reported them stolen to the Police department and I have named you in the report, so expect a call from them at least. If I do not receive my property and my payment by friday, on monday I have to begin small claims court proceedings. I'm sure you understand, and you've no doubt been through this before.

I am also going to call every producer, agency and union representative in the 411 and ask them if they recently worked with you and I will explain my situation and ask their help in getting my payment and my property back. Eventually, I believe I will find your clients and they will help me get my property back. They may even have an idea who took them! I should be a detective, I'm pretty good at this.

If you are concerned about the possibility of damage to your reputation, please don't worry about this. I assure you I will convey this information in the most professional manner with the utmost courtesy and I will speak highly of your skills and your demeanor.

I will say: "Hello Sir. Do you know Mr. X? He's a very talented DP. Have you worked with him recently? He's awesome and so talented. Anyway, the reason I'm calling is Mr. X rented my equipment for a shoot some months ago and I could have sworn it was for one of your projects. But, sadly, he seemed to misplace some very valuable property of mine and while I'm waiting for him to pay the invoice I sent him six weeks ago, I'd like my property back. Could you help me with this? .... What? File an L&D claim? I would, but Mr. X came so highly referred by Mr. Y, that I was sure his personal integrity would cover any losses. You see, when my friends refer people to me, I've been known to do them favors and extend my trust. Hey, sometimes it doesn't work out so good. Anyway, if you have any work coming up for a DP, let me recommend Mr. X, he's a good DP and the money you pay him can help him settle his debt with me and then everybody wins. How's that sound? Here's his name and information so you won't forget it."

Of course, this will take a long time. But can you imagine how satisfying it will be for me, while I await our court date, to be pro-active in the recovery of my property? Since you have no idea what happened to it while it was in your custody, I figure I can wait until you pay me for it, either voluntarily or by court order, or I can help you track it down. So, I have decided to help you track it down.

Bring cash on Friday to me or call me to work out the details of a payment plan and we can avoid all this extra work.

Unbeleivable!!! This guy sends me cheap ass wintek cards and tells me they will work perfectly with Red and listen to this he tells me "Your check is in the mail, you will receive the cards, leave me alone".
My blood is now boiling at this. Tomorrow I'm going to file a police report about the stealing of cards.

Is there any way for you to get in contact with the Producer or Production Supervisor/Manager?

Murali,

I'm not an attorney, but if I am in your shoes, I would also send those cards back to him with a written note (certified letter) that those are not the ones you rented to him. In certain circumstances, the guy could "argue" that you "accepted" them as part of the deal.

Thanks Jack. I will do that.
