Just noticed that RED changed their Terms of Use in 2012 to say:

"You may not copy, reproduce, publish, transmit, or otherwise use any copyrighted or trademarked materials present on this site without prior written consent. This includes using RED trademarks for metatags, in hidden text or otherwise using the trademarks for the purposes of gaining a higher ranking from search engines."

How do you copyright a metatag?? Does that mean people can not list there equipment on websites?? How will people search to rent RED gear?? Is anyone running into this problem??

It's like the end of their emails where they say the info in correspondence with RED is confidential yadda yadda. It's there, but there is very little legally they can do about it should you breach the "contract". The exception most likely being if ARRI were to metatag a site made for Alexa with marketing words used for RED in an attempt to steal site views and such, or possibly if you were trying to use the metatag to insinuate that you are sponsored by RED somehow when you are not. It's really not a big deal.

Stanley,

RED is after me for owning a "Domain" name scarletcamerarentals.com. I purchased this domain name over a year now and they want for me to transfer the domain name free of charge to them. They have also locked up my account at RED so I can't purchase products or get support. Here is a list below of other companies who own RED in their domain names or hidden text.. I've contacted a few of them and they say that they have NOT received a cease and desist letter. I guess RED is singeling me out.

RED like their IP in any form and as the company have grown significantly out of the backyard, it also makes more sense for them to fight for it.

Early on, anything "RED" was good marketing for them, as it heigthened conciousness around the brand. Not so anymore.

Tiimes changes as do RED.

Would be fun to take a path down memorylane and check the early concepts of R1 we were discussing and dreaming of.

The userbase and goal of operation has changed. As has accessories, prices and policies.

Mostly this is good!

Jake, you are so wrong! RED has locked up my account which has $3,500 in it. I can't access it until I turn over my domain name free of charge to them. That's not a big deal!

AFAIK RED has occationally been pursuing domain-names since 2008 at least.

As to the legaleeze, I am not in the know, but it is hardly a surprise.

I had quite a few RED-related domain-names back then, and used them mostly for info, not sales. But when I saw that comming, I just didn't bother.
Actually I sent Jarred the links and asked if it was ok. He said he would prefer I didn't.
Which was fine. I never made any money out of a domain anyway! :)

After all it s their trademark, isn't it?

:)

Gunleik,

Like Stanley said. How do you copyright a Metatag or Domain name?

Sure. But that's besides the point, isn't it?

The brand "Scarlet" in connection with cameras are probably copyrighted.
And RED generally don't want an yone to get a free ride with their brandname.

There are god and not so god angles at that, but that's it.

What do you want?
RED to buy your domain and park it for a sum?
Then why?

Or do you want to get on with the business of using cameras?

Sometimes one just have to prioritise what one want to spend ones life on.

Me... I like cameras, directing and phogtography.

You may have other priorities.

Cheers!
G

Tom,

RED has not singled you out and I won’t get into detail about the other cases, I would encourage you to work yours out.

Best Regards,

Michael

I'm new to this whole camera community but am some what of an internet geek. After checking out the first domain name, redmodz.com, it seems that they are very much involved with red itself. Either Reducation or trying stuff out at RED Hollywood. And yet, they have RED in their actual company name, unlike people like Digital 4K Planet Cameras or Raidiant Images. I'm not sure how someone like Digital 4K Planet can get their account suspended for having a domain name that points back to their main page, digital4kplanetcameras.com, and redmodz who have RED in their company name AND domain name can be teaching at Reducation...????

Better to err on the side of caution. If you really want to fight the issue by all means go ahead. I would concede and change as in marriage, some things are not worth fighting for.
I will say this, your site has to do with renting and making a profit while the other is more for education. Think of it this way, its like Apple.com and Macrumors and Red allows RedRedmodz.
Cheer up just change it to Dragon Rentals :) that should buy you some time or maybe Monstro Rental

"Think of it this way, its like Apple.com and Macrumors and Red allows RedRedmodz."

Yes, but can't you buy Apple products at AT&T, Verizon, Best Buy, Target... etc? Because AT&T gives customers their phone plans, a service that Apple does not provide. Just like camera houses provide rental services that RED does not, (and all the other equipment customers need to actually make the camera work).

But do you see any of the companies you mention (AT&T, etc...) owning and actively running domains like "AppleiPhonePlans.com"?

They may not own and operate sites like appleiphoneplans.com, but they sure will pop up when you go to Google and search for "Apple iPhone Plans." They will also have a page on their site titled "Apple iPhone Plans" with metatags that also contain the phrase "Apple iPhone Plans." They would probably even have a dedicated page with a url like www.xyzretailstore.com/apple-iphone-plans.php. I think the point is, according to the new terms, having a dedicated page on your site mentioning a RED trademark would be in violation. How can a RED camera owner/operator advertise his gear/services without using a RED trademark?

I think the real question being asked here is what exactly is and isn't acceptable? Why do some domains seem to slip between the cracks, while others are still up and running? RED trademarks being unacceptable in company names, even domains is one thing... but I can't see how a company can say you are infringing on their trademark by using metatags. Seems a bit like cyber bullying...

Nicholas, those companies are authorized by Apple to sell their product (with add-on services), but that is besides the point...

I can see what the main concern here is and the way I see this is that this is for RED to be able to protect their interests in case anyone decides to use it in a "wrong way" - which of course is open to interpretation. My interpretation is that if you are a genuine owner of RED products and advertise your services (that use the RED product) in a way that is not taking advantage of RED trademarks (i.e. using RED name in your domain address, using RED pictures on your site, etc...), you will be fine. But if someone decides to "take a free ride" - they have the tools to deal with it in case they decide it is too much...

Why some websites seams to "go under radar" with RED in their name? As it was mentioned before - most of these have a close ties to RED and in most circumstances they are using the name with RED consent (or at least a tolerance). There is so much we don't know...

Either way - follow common sense and if you are not sure - RED is just a mail/call away. Better be safe then sorry...

How do you advertise a RED Rental service without SEO related domain names or pictures of RED Cameras on your website?? What are you suppose to say on your website?? "I have some camera gear to rent but I'm not going to tell you what it is. Come rent it" ???? That makes no sense and is impossible.

I feel like this is hurting RED more than protecting their interest. Doesn't RED want camera houses to rent their gear and keep coming back to them to buy more equipment???

I meant RED pictures - as a pictures taken by RED of their products. You will be surprised how many people use RED's pictures (mostly taken by Jarred) on their websites. I don't see any problem of using your own pictures of the RED products you own...

Yes but those pictures have metatags in them with RED copyrighted words and RED is now saying you can not do that.

Has anyone noticed that guy Tom Jordan with Digital 4K Planet was banned from Reduser for owning a domain name? It looks like he was singled out.
