  • Hey all, just changed over the backend after 15 years I figured time to give it a bit of an update, its probably gonna be a bit weird for most of you and i am sure there is a few bugs to work out but it should kinda work the same as before... hopefully :)

Shot on SCARLET X

The audio sucks in a couple of places, were working on getting a new shotgun mic. We are really totally brand new at this, so yeah it's got some flaws, but we'll get better as we progress.

Just wondering if you feel nervous using copyright music from sigur rós? Not trying to be a downer but I'm sure you got paid to make this video right?

I don't mean to open a can o'worms but whether or not you got paid has nothing really to do with it. It you are copying and distributing copyrighted material (Posting on YouTube etc. constitutes both.) then you may be held liable. I'd be concerned to some degree. The more success you have, the more damaging it gets.

Good job Jon. Liked the interview style a lot. Those J cuts in the beggining were nice too. Loving the RPZ a lot. It exccels every time. I shall have a hard time choosing between the Pl and canon because of it I think.

To Scott :
I'll have to check about that copyright stuff. If you dont make any money out of it all you might be able to use it especially when using small parts only. Best thing is to reference it at the end of the clip or movie. For commercial things its a no go for sure.
As a safest rule its always safest to use royalty free. But royaltyfree are not as good as certain popular songs of course.
Just a point.

Anyway I think overall you did a very very good job.

I actually think it's rather hilarious that a church uses music by a gay atheist without permission...

As for the copyright stuff - it doesn't matter if it's for profit or not, what matters is whether or not the copyright owner allows it. The default position of any content createor should always be "no, we can't use that" until proven wrong.
Videos get taken off of youtube daily because they include copyrighted music.
I would change the music ASAP.

Great work Jon, interesting project...
I like the look of the Red Primes very much, unfortunately the lenses are too expensive for me. Have you connect the mic over the A-Box from Woodencamera?

If the artist who made the music spoke and said music can be used for free in non-commercial ways it's fine, if they didn't it's never allowed to use copyrighted music for public views (including youtube/vimeo etc.). I don't know why copyrights are so hard for people to understand, it's pretty simple: never use someone else's material without their permission and/or guidelines for use. Doesn't matter how much people try to justify use that break copyright laws, it's never permitted to use any music whatsoever if the artist isn't involved or has pointed out that it's ok.

What makes me a bit pissed is the number of individual professionals and even larger companies who use copyrighted music for their showreels. I'm always stunned by how difficult copyright laws are to some people, it's the easiest law to understand next to "stop at stop sign". Don't use other people's music without permission, period.
This is why my Epic test footage is totally silent throughout, didn't have any music so I rather have it silent and people complain about it then break copyrights to make it shiny, I don't have any rights to do that.

Copyright is never about profit.

No i didn't use the A box, I simply connected the mic via xlr to my H4n Zoom recorder, then ran an 1/8" y adapter out of the output jack and into the line in on both mic 1 and mic 2 on camera, and it worked without any problems. I didn't even have to push the record button on the H4n, the signal flowed awesomely.

I've had to deal with a few copyright issues (not my own, but I had to wade through the legal stuff)... So many times an artist has said its fine to use their music on another persons project, and then the filmmaker found themselves in court.. why? Because the artist rarely has the right to say that. The record label / distributor has the right to retain and approve the right of any music the released, or paid an artist to create, irrespecitve of the artists say-so.

I'd love to live in a world where an artist can have the ultimate say on how and when their music is used, but these days its a rarity.

The label typically retains the rights to the physical recording, while there is frequently some other entity (or several, often including the song writer) who holds rights to the song itself. You need written permission from both rights holders to use the material. Say so is as useful as the paper it it written on.

I've been dealing with exactly this issue. Nothing for profit, just wanted to use some music on a wee brag reel thing I'm working on. Spoke to the agent for the band, and the label, yep need rights for both the music and the recording of the performance... followed it up with email... silence was deafening. Never heard another word from either of them.

Qui tacet consentire videtur? I don't think it's safe to assume that!

I don't normally deal with this stuff; I'm just a guy behind a camera. Isn't there some performing rights society you can go to to get a single point of contact for small simple stuff like this?

Mike

The guilds offer services (http://www.bmi.com/) (http://www.songwritersguild.com/.html)

The Harry Fox Agency is pretty big (http://www.harryfox.com/index.jsp)

There are others... It depends upon what kinds of rights you need. As I recall, BMI is more useful for paying royalties for air play than it is for securing synch rights, but it may help you locate rights holders or their representation.

Nice simple way for audio Jon . I think the H4n is a real breakthrough in sound recording . Used it many times. Never fails. Any way to connect it to Epic or scarlet is a go for me as long as there is a clean signal. I think for vocals its superb..

Even used it to record voice overs in a portable setup. Awseome.

Why the hate guys? Good job on the clip - looks very nice - especially the close up portraits. If you want to attack his copyright or the political nature of the song he used, go to another forum. This is a camera forum.
