To me, that would constitute a contradiction right there.

Like you say, they have a semi-working prototype. They admit that it is buggy, but it shoots footage that has been released.

There are no reasons to think that the software bugs won't be crushed and that Scarlet will be released. Jim even stated today that he thinks "end of summer".

Vaporware is something else. A small finnish firm comes to mind, Bitboys Oy. Back in the day they claimed revolutionary technology for rendering graphics. They showed screenshots and the like, and claimed their graphics card could do this and that. But no one ever saw it, and to my knowledge they still haven't released anything. That is vaporware.
