AVID is publicly traded.
Most of SOX has to do with financial reporting and accounting. Almost anything discussed regarding RED would not adversely effect stock values or financial fundamentals. I think a disclaimer in a signature would probably be fine.
No it wouldn't. Here's how SOX and Support Guys are tied together in this specific example. The following is a fictitious example.
A support person hears some internal whispering about what Final Cut Pro is going to do in the next release. It's amazing and cool stuff and will change the way editorial companies interact with media.
He talks about it on a few forums. It gets picked up by someone from Gizmodo or Lifehacker and published on their news pages. Because it's Apple and this is huge news, it also gets picked up by some fairly major technical media outlets and gets reported as fact.
Over the next few days, tens of thousands of people buy FCP bundles because of these upcoming features.
The problem is that it isn't true. The support guy has just heard some internal rumors that have nothing to do with actual Product Development.
So now, Apple has just booked Accounts Receivables as assets because of fictitious forward leaning statements.
And that is a SOX 404 prosecution waiting to happen.
So, instead of taking chances like this with their products, because a little whisper about iPhone future features can actually have major impacts on stock price - Apple clamps down *hard* on employee speculation.
I don't blame 'em.
This is more about Apple not figuring out how to handle pro app customer interactions (or caring to). They don't show up in Apple stores all day long and complain like iPod and iPhone users do.
It is both. Believe me, SOX and forward-leaning statements are something that is taken extremely seriously by tech companies.
