  • Hey all, just changed over the backend after 15 years I figured time to give it a bit of an update, its probably gonna be a bit weird for most of you and i am sure there is a few bugs to work out but it should kinda work the same as before... hopefully :)

Legal Action against Carrion Monitors

Well i d personally think for this guy it would be much easier if he come on this forum and said well guys forgive me i am still there all will be sweet. Like RED did for more then a years :) I ma sure most would forgive.

guys. the guy has taken your money for more than a year without any notification on when the product is due to you.. this guy is fraudulent. send him an email, asking for your money back. give him a week to respond.. if he doesnt respond take his ass to small claims court. get your money back + court fees + lost wages

I respect your position Emanuel.. But... Perhaps the more accurate thing to say is not that the guy is dishonest, but he over extended himself which has lead him to betray the trust and patience of his customers.

That said, it's time for him to make it right with these people and quickly.

He needs to sit down and contact each and every one of the people waiting and give them a dependable ship date, or give them a refund within 48 hours of the communication.

This is common sense, as your friend, you need to tell him this.. If he does not do it within a week, then I fear regardless of your beliefs, his honor and honesty is in question.

Jay,

I am not inside his sales or business model. No idea about any details unless what has been posted online or arrived to my PM box from the customer side asking my mediation.

Everything I know is that I've been referring the case to Luis, he has let me the idea he's on track for solving the matter as it should be. The only thing I know is what he said to me a couple of weeks ago (nobody had asked me to -- I asked him 'cause I wanted to order two units or one at least):

«I must supply the other orders first or I'll have to send the money back. I can't accept more orders for now (friends included).»

I have no idea if there are other suppliers who may have his/your money and he may be on the road trying to solve the issue. I simply didn't ask. To each his own. What I know is that your money is in good hands. This guy is a decent person. You didn't lose the asset. It's your right to ask it. But perhaps he can't do it right now. And he may be ashamed to admit it. This guy has principles and the cleanest reputation among his friends. Give him time. He should surely come up and clarify you all. Hope he does. I am sure he will surpass this barrier.

He's always traveling, so it can happen he hasn't had notice about this thread. In this case, he will.

Think positive. Even if for any reason there's some unexpected trouble in-between, he will refund you up to the last cent, I am sure. Just think on this. In spite of being myself aware of all this, he had the chance to receive more $4000 from me and he did nothing in order to get it. Quite the opposite.

also, go on to BBB.com and file a complaint against his business
Zakaree,

I have a case with a seller based in California (San Francisco). Took me almost $1000 and I never saw the Sharp DT500 projector plus an Epson screen I bought and paid via wire transfer as requested from an ebay seller with 100% of positive feedback. I don't have his details. But once he has bank account to where the money was sent, the banker should have them.

I know I am the lawyer on duty over here :hat: but might you help me with your laws and legal authorities in the US?
Once the guy now says he sent me the item when it never really happened.

Don't mention ebay. I placed my confidence on a flight scheduled to the US when I'd order the shipping then; which didn't happened before the 60 days for the feedback procedure and my tool. My fault. Besides, I wish ebay had changed their name to emanuel.com :sarcasm: -- 'their' fault.

Can anyone help?

Thanks,

E. :-)

Just a note, he isn't actually still taking new orders. If you hit the order button on the site, it goes to paypal with a message that the user isn't receiving money right now. He probably hasn't touched the website in months.

Emmanuel is an honest guy, so if he says that Luis refused his money, I think it is likely that Luis IS trying to fix the situation. I do think it is pretty awful to take someones money, not produce the goods, and not respond to the queries of the customer even if it isn't his fault that the devices aren't shipping.

I'm sure everyone on this forum who's waiting, tried to reach him and that's why this forum exists. The "honest man" label is simply words. Your character is as strong as your actions or as weak by lack there of. What's really sad is that someone other than Luis is doing the talking for him.

Even if he intends, one day, to deliver without a shipping date or communication, intent be damned, the end result is no different than theft. For a pro user, 2000 dollar monitor becomes a whale of an expense when you factor in the lost time and money from having to subrent while you wait. After you factor in the subrentals and time to track down a monitor, by now the cost must be closing in on or has surpassed the expense of a Panny 900.

And that hurts. No amount of testimony to a man's honesty covers that cost. If I were taking this guy to small claims it would be the cost of the monitor plus every subrental cost after 6 weeks of waiting, and my hourly time in having to pick up/drop off subrentals.

The hardest part about small claims is collecting. Good luck.

Yes, the lack of communication has no excuse. He knows what I think. I'm just posting 'cause I have some information (already posted) and a personal POV and experience with him which can help everyone in behalf of the truth. And for friendship. I am loyal to both. He didn't ask me nothing at all. Still waiting for his entry as any one of you. Who knows my posting activity in certain forums, knows that's not my type to be silent. When both values are on the table. Can't understand how anyone might be silent. Nothing is better than a proper enlightenment. Every question should have an answer.

Thank you Emanuel for the information and the communication you had with Luis. The best thing he can do is get in touch with the folks that have sent him money and let us know what his intentions are -- and then stick to it. I think that our business is full of small entrepreneurs whose vision sometimes turns out to be harder than they thought it would be to realize.

I know in my life I have sometimes owed people money for a long time and they let it pass because they knew me, until it was paid. Sometimes it happens. But I always let them know what was going on.

But in any event, he does need to let his customers know what is going on with their money and their monitors or sooner or later it will inevitably get to be a worse problem for him than it is now.

I sent an alert email to Luis about the existence of this thread

One thing that Luis has to fix is the communication and getting the order out, nothing else... his monitor is wonderful..

Just a thought,

If his monitors are amazing as most say it is (which i believe they are from the amount of positive feedback it seems to get)

If he isn't taking money right now...

If its true that his working on it...

Then I believe his reason for no communcation is simple, either communicate or work...hard day and night and get as many of these done and send them all out, His not RED guys, his a one man show trying to please a demand he probably didn't see coming and thought he could handle on top of his normal work...

I'd think that no communicaton is fair enough to say thats not right but as long as you have someone here saying he is working at it, (think about this, its a real names forum so thats Emanuel's name on the line) then really I think this idea of a 'law suit' should be held back, imagine if your monitor was in shipping right now and you just started up the law suit? Wow...I'd feel bad, considering that it probably was true that the guy was working hard amongst his other commitments...family...work... etc.

Just stop...take a deep breath of fresh air...open the windows...cool down...and just chill...or as many of my mates say 'take a chill pill'...
You placed your money in his hands, you have someone in your community telling you its in good hands, have some faith.

In terms of a court suit, the maximum an individual can sue for in small claims is $7500. Certainly, that would cover the money that was paid for the monitor and perhaps some subrentals, etc. But I would imagine, the lawyer fees and the hassle might not be worth it.

In any event, I think that Luis is a good guy. I will agree with everyone on here that communication has to exist on a regular basis if deadlines are going to be missed. Otherwise, it's time to send back the money to the customers and perhaps try a different business model. For example, Luis may want to build monitors in his spare time and sell them on a first come, first serve basis based on what he has in stock. Obviously there is demand for the monitors. Maybe too much demand.

$2,000 is a lot of money to hold onto for an extended period of time. When RED did this with the cameras ($1000 deposit) it was a little different. The camera was a little more unique than say a video monitor. Plus, the customers knew going in this could be a wild ride. $2K can go a long way towards other accessories, and it's only fair to send the money back if there is no foreseeable delivery date.

I'm not a big fan of lawsuits because I think many times they can be avoided by simply talking things out and coming to a compromise. I would call on Luis to start an official thread that provides regular communication or to start emailing/calling his customers. This will go a long way. Many of us are busy. Many of us travel. You still have to be customer service oriented in order to stay in business. I have met Luis in person, had conversations with him, and he seems to be a good guy with good intentions. This is just one of those "falling through the cracks" moments that needs to be addressed in my opinion.

Then I believe his reason for no communcation is simple, either communicate or work...hard day and night and get as many of these done and send them all out, His not RED guys, his a one man show trying to please a demand he probably didn't see coming and thought he could handle on top of his normal work...

Ah, if only this were true. However, I know he was in New York for quite some time recently working on a TVS. Now, even this wouldn't be a problem if he took five fu@&ing minutes at the airport on the way to the job and UPDATED us. He's been given the benefit of the doubt for entirely too long on this BS situation.

The idea that a person is so busy that he can't update his customers is ridiculous. How long does it take to make a post? how could months go by with no regards to communication? Why didn't he stop taking orders when he was overextended last year at this time?

Hey Guys,

I'm sorry and sorry just won't cut it any more. I understand. My lack of communication is unacceptable. I am just tired of making empty promises that I do intend to keep, but the time constraints in which I'm do no allow me to. I much rather just start shipping units and get up to speed on these units and then come here and say, hey guys, I shipped 2 units and the next too are really 2 weeks away. rather than say ok I will ship and then be swamped and don't do it.

Thank you Emanuel for the kind words.

Thank you everyone for voicing your opinions here and not getting a voodoo doll of me and stabbing a hundred pins in it.

I am still here and I do not intend to keep peoples money or not deliver on these. I will even if it kills me. I also understand that everyone has wasted money waiting for these so I will try to send a little extra cash with the monitors just to say I'm sorry.

Will get back to you with more info shortly.

Thanks,
Luis

Hi,

Thanks for the update. I assure you the last thing I want to do is bring lawyers into this. It is just frustrating to have 2 grand tied up for more than a year and nothing to show for it. 14 months ago, two grand was not that big of a deal, now that the economy sucks, it's more of a concern.

At any rate, thanks for the update. Just be honest with us and let us know what the deal is.

Cheers,

Nick Gardner (Gardner Films)
