FYI- Sales tax isnt a one time responsibility. Sales tax is due on every sale, so technically the new buyer is obligated to report his purchase and pay sales tax again.

Double taxation!

Assuming you're talking about the U.S. -
That's State specific. In AZ we don't pay sales tax on transactions between final consumers. Once it's paid at a retail level it's done. A few States have no sales tax ever on anything.

In the case of RedRocket anyone buying outside of California from RED would not owe sales tax anyhow. (disclaimer... I'm not a tax accountant)

If you buy something out of state and have it shipped to a state that charges sales tax, it should be reported on you State income tax form. I usually put about $200 worth of purchases or so just to cover small items I bought on the internet. They only charge about $20 in sales tax for that, and I figure it's worth it to keep the audit likelihood down.

You moonlighting with the IRS? ; )

No, just trying to clear up a common misconception. If you want to run a business you should be familiar with the laws.

FYI- You cant transfer a sales tax you paid. You paid the sales tax, its done. If you sell the gear, the buyer is responsible to pay sales tax again. Its not a grey area.

Double taxation is a totally different principal that has nothing to do with sales tax.

That's the most ridiculous thing I have ever heard.

Ok well I tip my hat to you for following that rule, but if for instance I was buying a used camera off of craigslist and the seller whipped out a calculator and tried to charge me 8.25% in sales tax I'm pretty sure I'd walk right out the door and I'll bet I'm not the only one.

It may technically be the "law" (and I suppose if you're selling tens of thousands of dollars on ebay then you'd want to consider it)... but the average daily ebay/craigslist transactions most people (both buyer and seller) are more than happy to pass the savings & lack of hassle along to each other. I doubt the IRS is going to come knocking on your door for something like this... but hey weirder things have happened I guess.

That's not what Greg is saying. Sales tax is the responsibility of the buyer. Only those with proper sales tax licenses issued by their local taxing authorities can collect sales tax. All he was saying is that it was pretty much meaningless for the OP to say that sales taxes had already been paid. If you go and buy that Rocket card and write a company check for it, then happen to get audited next year, you could very well be liable for taxes on that purchase. That applies to anything you buy where proper taxes are not collected by a licensed retail entity.

If you buy a car off craigslist, you will have to pay taxes based on the purchase amount on your bill of sale when you go to license it. If you buy $25K worth of camera gear off craigslist and pay cash for it, no one is going to know about the transaction unless you or the seller report it to a government agency or if you happen to have that $25K listed on your books when an auditor grabs onto them.

Not in Arizona. But that's true in California. Again, I'm pretty sure this is all State specific. Alaska has no sales tax, for instance. There is no federal sales tax.

Sounds like this is really a California conversation since that's where RED is... not sure specifically about film gear in California. I thought there were unique provisions for film gear there.

It is a state sales tax, so if you live in one of the few states that are tax exempt, you are lucky. Otherwise, if you are a ligit business and you dont report the tax you could end up paying alot more than the tax you avoided in penalty and interest.

digitalfx:jacked: What happened to real name policy any way?

In fairness, I do feel the thread was high-jacked to some degree. But on the otherside, the item being sold is relatively expensive. That being said, the few people in the community that could easily throw down $5k would be a business type enterprise. A business enterprise would be concerned about taxation/implication issues.

That aside, the man just wants to move his merchandise.

if i am not in california i can buy this directly from RED for the same price and help strengthen my business relationship with them. If i am in california i might be able to just pay 3.5% tax. you might want to take that into account in your price. can't you just return it, since it is, as you say, un-opened?

Thanks Mr. Halsell,

I wish they could know that this is a "Jobs / Equipment For Hire" area.

This is a post about a RED Rocket™ for sales.

Thanks

Michael T.
