By purchasing out of state (or in my case out of country) CA state tax isn't collected. But does anyone know what happens if you want to fly in and collect your camera in person?

Does it become a local sale and mean tax would be collected? Or is it locked in when you make your purchase from outside CA and it's a grey area of delivery?

I know there are refund schemes but this seems like a bit of a hassle.

Does anyone know what has happened with others who have done this?

Cheers,

from what i recall ...
if you pick it up in CA - you pay CA sales tax ...
there might be a refund you could apply for after you leave or at the airport ??
you could try the Cailf state board of equalization to find out ...

i know a person in the 51- 100 group that went to Red day .. went over his camera's & accessories and then left without them .. he had them shipped home (another state )...

Hey Donatello,

Thanks for that.

That certainly represents the tax reality as I know it, just wanted to know if anyone had a workaround as I would prefer to hand-carry the body.

I'll look into the refund scheme, maybe it's not a big hassle.

Cheers,

Jim

Id like to know if we can use our resale number to bypass the sales tax!

i'm not sure you can use resale unless you are planning to sell it ???
also don't forget the 6378 CA use tax exemption for post production & teleproduction ( exempts 5.25 percent CA use tax - you pay county, city etc = approx 2 - 2.5% depending on where you live )

6378 comes under Reg 1532 - forms are included in PDF
http://www.boe.ca.gov/pdf/reg1532.pdf

I would like to shake down my camera before taking it into the global wilderness.
Anyone know what would be the tax situation if one was to get the camera shipped to Nevada, use it and export later on ?

no tax ... the person that i mentioned in post 2 - had his shipped home to Nevada ...

Our equipment goes into our rental inventory. In Wisconsin that equipment is not subject to sales tax. I believe that this is on a state by state basis but you might want to consider looking into it. Of course you do have to have a legitimate rental business.

you can ship it out of state but technically (and legally) you have to pay a "use tax" if you bring it back into CA. If you want to rent it, you are supposed to charge your customers sales tax if you didn't pay the sales tax up front.

the 6378 exemption clearly states that if you qualify under it as defined in regulation 1532 it is not subject to tax measured by rental receipts..

regulation 1532 page 6 # 3 - 1st sentence ...
http://www.boe.ca.gov/pdf/reg1532.pdf

you'll have to decide or get advice on if you qualify ...

under 1532 - if you sell it within a year you have to pay the USE tax (5.25) ...

if you live in CA and are trying to have it shipped to another state to avoid sales tax .. be very careful .. bottom line comes down to where you live .. if your banking is in CA or you have charged on a CC that has a CA address or you file CA state taxes - you don't live in another state .. you may or maynot get caught ...

not that i bought a new auto in oregon/registered there and brought it back to CA and in the end had to pay CA sales taxes , fines/interest ...
how did CA find it - dahhhhhhhhhi took depreciation of auto on FED tax forms and in CA you have to send a copy of 1040/etc when you file state tax forms .. i guess they do look at the 1040's ...

just in case the CA tax board see's this .. i did buy 103 under 6378 on Dec 31 ... then on Jan 3 i called Red and begged them to let me pay the CA 5.25 use tax - and they let me pay it - so enjoy it CA ...

Pretty much cover the tax issue, don't you guys love CA taxes...

your more then welcome to change the address of delivery with us but once its in your hand out of our doors its up to you to claim in or not as donatello has shed quite a bit of light on the subject.

taxes.....so cool!

..

But Page 2, #4 states that this is only for Post Production....and not any "production services or activities."

Which cuts out camera rentals. The bottom line: if you pay the full tax, you will not have to charge clients tax on the items. If you do not pay the tax, all clients of yours will be required to pay you the tax on each rental, and you will have to remit it.

reg 1532

reg 1532

So according to reg 1532 we should NOT be able to use this exemption for the RED camera right? It says the exemption is only for equipment used for "teleproduction and post production" services and not for production services. Is there something I a missing here. I wish they would make tax laws a little less confusing, but I guess that's why there are accountants.

Has anyone actually used this exemption successfully? If so, what's the process you had to go through with RED?
