Need help or advices :)

Last month, I have bought a RED EPIC #295 from someone in NYC (http://www.reduser.net/forum/showth...Scarlet-amp-Accessories&p=1474327#post1474327 I have deal with the thread owner and the company director). I made the withdrawal before as the person looks reliable and there was no other way for me to bring the money (Imdb checked, his company was registered, long time red users, got his ID scan, etc.)

Once I get there, accessories were missing, other were damaged so I didn't took the camera. Now it's been 2 months, I'm back in France and he doesn't answer my mails anymore, obviously nothing on my account. At first he pretented of a problem with U.S to France transfer, wich could be true. But then I provided a U.S account number to make the process easier.
I don't know what to do to get my money back. I'm a french student and this was my biggest investment ever (24500$).

The solutions I thinked about:
- Getting an attorney there. Looks really expensive.
- Contacting forums, groups and all his contact on facebook to know what is happening. Maybe not legal.
- Getting there, and find a way to meet him again. and then?

If you guys have any idea, contacts that could helps, this would really help me.
Thanks a lot in advance !

* I am NOT a lawyer *

I would start with the following :

1) report it to the police
2) Contact companies where there is video evidence of what happened
3) Get affidavits from anyone involved in the process.
4) Ask your citezens advice bureau for advice (free)

I feel for you and hope US based folk can assist you.

If you can change the subject title of your post you should and in the future avoid characterising the exchange in public forums as being fraudulent.
Stating the facts is enough for the reader to make up their own mind about the ethics of the seller.

best

Just to be clear, did you pay $24,500 to the camera owner and you did not take possession of the camera?

Thanks all for your advices. I don't know why but it's relieving to see some messages about it :).

And yes thats it !
I made a transfer in advance, and then didn't took it as the camera and accessoires were not as describe. So I asked him to do the transfer back quickly.

Any legal and criminal resources at your disposal, can be used to satisfy what happened with the transaction. Recovery of the funds and/or camera is unlikely.

As a new Red user, I only heard about it and asked. But the guy told me he has sold all his cameras without and that it was not mandatory and usefull ( I got him now... )

Long time reduser? I don't have much advise to offer, but I would be interested to know who it is that thinks they can get away with ripping someone off for that much money. Surely it is legal to private message the identity of this person to anyone interested. I just got ripped off $122.56 from Time Warner Cable and I feel like hunting down the person responsible and ruining their life. I can't imagine getting ripped for $24,5000! Sorry man. I hope you get it back soon!

If this has only just happened ...

+) I would contact your bank and the remote bank and advise possible fraud - Ask them to hold the funds in the remote account
Advise that money was taken for goods that were not delivered.

+) As this amount is > $10,000 ...there may also be some AML (anti moni laundering) interest from his bank.

If this was me ... I contact every legal area that I could ... even the FBI!

I would also advise the person that took your money that the FBI case.

Act as soon as you are able..... it is very difficult to escape the long arms off the law.

The title of the thread says you have been robbed.
So unless you have sought specific legal advice, it is not prudent to name the individual as you are accusing him of a criminal act.
From what you have said there may be significant "wiggle room" for him to create a defense as to why he has your cash.

In general such matters of non payment are dealt with in civil court.
Possesion is 9/10ths law.

Be careful about naming him in public.

I will send a message to RU in order to change the title.

I would like really like to contact everyone I can, FBI included but I don't know any reliable attorney or the fbi cell phone :D ! Would you have to recommend in New York, or at least which kind of attorney to contact ?

thank you again !

Gandalf,
From my first read, this situation seems to fall outside of the FBI's mission.

You inferred that this was an electronic payment / transfer. Was it a French bank? If so, your best chance at recovery may be by working with your local government policing authority (perhaps the equivalent to the US Secret Service) and that financial institution.

You mentioned that this happened in NYC, but not specifically which borough.
This link will provide the appropriate location for where to report:
http://www.nyc.gov/html/nypd/html/home/contact_information.shtml

Be aware that New York City does not accept complaint reports over the phone or over the internet. The complaint report needs to be done in person at the local precinct. Am not sure if it needs to be you or if a proxy (such as a lawyer) can act on your behalf.

Is there a reason you did not contact authorities while you were stateside?

Good luck

Thank you very much for your help.

This is really unfortunate as I would have liked to brag about having contacted the FBI, but I'll deal with it :)

I have two friends In New York who should be ok to help me, just have to see if the main place is where the guy lives or where we made the aborted transaction.

I I did not contact them at the moment cause I had only 3 days more and I know that the transfer could take more.

This thread has been ok until now, with help and advice. Please do not turn it to slander.

I dont one know what the agreement was and I do not know why there was no mechanism for you to say no upon inspecting the items.

What at I do not understand is why you did not wire the money AFTER seeing the goods? To me the approach might have been.

1. Meet with my bank and let them know I would be leaving the country and would be calling to either transfer or not transfer the funds.
2. Fly to NYC, inspect the goods the day I land.
3. Everything ok, call my bank and order the transfer
4. Recieve goods when tans fee complete. 2 days max?

the problem seems to be 2 things,
1, prepaying for goods with no protection, (PayPal might have protected you here)
2, no agreement or conditions if you did not want the goods.

There is a scammers thread database on reduser.
