  • Hey all, just changed over the backend after 15 years I figured time to give it a bit of an update, its probably gonna be a bit weird for most of you and i am sure there is a few bugs to work out but it should kinda work the same as before... hopefully :)

Sharp 4K Film Competition

Bejorn,

You can use my address. California. Knock one out!

So I just skimmed through this thread, and before I go into creativity mode. So can we do this without a US adress, or no?

collaboration is good. using addresses that do not belong to you to avoid legal restrictions in a competition is not wise... the film festival has an internationally open submission, does it not?

it is also awarding a screen from both sony and hp (oh, and some red kits) and it's probably going to be awesome. multiple entries are OK - you could do a short for the festival as well as something specific for the contest. just remember there's a selection process and film festival entries need to be received before halloween.

Hmmm, interesting....

"The Submission must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous."

Ownership of audio clips used in samples should follow copyright laws and practices.

basically, you need to have written permission or it needs to be a legitimate remix or otherwise obviously fair use. if there's any question about that i'd say no - nobody wants a potential claim/lawsuit.

http://en.wikipedia.org/wiki/Fair_use

Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.[SUP][4]

http://en.wikipedia.org/wiki/Derivative_work

A “derivative work” is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship, is a “derivative work”.

---

"transformative" is a key word in all of this. you can't just rip someone's song and decide to use it with your images because you think it fits well. it must in some ways be commentating, adapting, and changing the work. some artists have traditionally liked to mess with the edges of this, i'd advise against it unless you just want to make a point about us copyright law (and expect to be effectively disqualified). if it's clearly legitimate and transformative, go for it.

International contest laws prohibit most companies from opening up outside their borders.. The legal fees alone to even do the groundwork to set up an international contest exceeds the budget that most companies spend on the prizes and marketing for all contests in their entire lifetime... and given how often those laws change you would need to pay that expense every time you ran a contest.

The US even is a nightmare within itself... there are some states that require you to fill forms and pay all sorts of contest filing fees if the contest is open to their residents and if you don't pay it its a criminal offence...

When is the RED leadership going to move into government? I am certain you guys could clean things up in a year. You have an army of producers that would jump at the chance to handle all your media needs. :)

I'm always up to collab, too, but how do you split a monitor? Sell it, and divide the cash? I would rather have the screen. :)
