Today I´ve got an additional claim from austrians customs duty office.( bought my RED One in MAY 2008)
Ther was an mandatory tariff classification from last year that the RED One has got this tariff number: 8525 8099 00. That means 12% importduty instead 4,9%.
This is valid for the whole EU

In Austria (I had a Telephone call with the custom office) they are now looking for all Red One buyers and claim the additional duty. There is one month for an appointment.
Maybe RED Europe can help us here.

I also heard about this from a friend. They requested him to give a detailed explanation of what each and every part he ordered (rods, mount plate, harddrive, cage, batteries, charger, ...) was used for.

We assume that they want to raise the import tax of the whole package to 12%. But by arguing that everything apart the body itself is standardized camera equipment we hope to keep the original tax rate for those parts.

Problem is: it is referenced into the European Binding Tariff Information database (EBTI-database) run by the European Commission and the woman at the CustomDuty in vienna told me, they can´t ignore this database, which normally is valid for 6 years.

Further she told me that this verfication is based on an explicit request to a RED One from a customer included a technical inspection. It is valid throughout the European Community, regardless of the Member State which issued it.

I don´t know for shure which are the technical differences about this classification between this two TARIC numbers:
8525 8091 00 4,9% original May 2008
8525 8099 00 12% new
I wrote an e-mail to RED Europe and hope they can verify and help me.
I think in the next days and weeks a lot of eu- buyers will get letters...

Technical equipment can be used for a lot of differeant purposes. The custom in EU decide the tarrif based partly of HOW this is supposed to be used. If you plan to get a camera and dip it chochlate and sell it as candy, you get a totally new tarrif. (Bad example, but sort of)

Check ot the codes before you start talking to the custom. Only you know for sure the proper one.

How can they charge you AFTER you made the import ? O_o
It's called wealth transfer ... after they take your guns .... they can do whatever they want ... you have to pay the salaries of Government workers ... that is their industry ... you get the Government you deserve .... as the man with no name would say ... "He should have armed himself". Maybe they'll charge you interest on the late payment.

Exactly. I said it's used mainly for still photography so it's a digital still camera with a duty of 0%.

Hey Alex, beware... if they found out about the cat... they will charge you also.
They need not to colect taxes but steal money... it´s another ballgame.
Revolucion is needed. Take cover!

Let's not go there ...

Today I got a letter from the Customs warehouse.
They dismissed my appeal.
Reason is (it is not a joke):
Basically they wrote:
"USB ports allow a bidirectional access to the Camera
even if they are only used as a voltage out, they are there"

So TARIC is now: 8525 8099 00 means 12% Duty

I could do another administrative appeal but it´s too ridicolous, so I give up and pay.

Can you pay with chickens and salt like old times? Since this seems to be an heritage how the kingdoms back on the 5th century collected their taxes.

I'm an honest hard working guy. Last week driving into Canada across the border from the USA, I get asked the standard question, "Did you buy or receive anything while in the US?". I wonder how many Canadians the Government employs and gives indexed pension plans to, just to ask honest hard working Canadians if they bought or received anything. Half of Canada must work for the Government. The USA is headed in that direction. The destruction of free enterprise and it's replacement with bogus government jobs will head us back into the Middle Ages.

I'm also surprised that they can charge additional duty retroactively. There have been a few cute remarks regarding it, but no one has said how they can actually do this? I can see them changing the law from today on, but retroactively? That's just nuts!

Having said that, in Australia the State government is trying to back out of solar contracts they signed with households across the state, reducing the amount they pay for the electricity provided. They will probably back down after all the negative press, but they still are trying it.

Ridiculous!

I wonder how they will achieve this noble goal :-)
My understanding of laws (and by-laws like rules etc) is that they can´t be applied retroactively.

OTOH if RED Europe were to go into selling cameras in the EC at some point, this whole BS will be handled by their importing agency.
